Article 1 - Purpose
The present terms and conditions govern the sale by Chef de File of high-end specialized clothing and accessories and Chef de File merchandise.
Article 2 - Prices
The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated, and exclusive of processing and shipping costs.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned.
Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the company Chef de File. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to check with your local authorities.
All orders, whatever their origin, are payable in euros.
The company Chef de File reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the tariff in force at the time of validation of the order and subject to availability.
Products remain the property of Chef de File until full payment has been received.
Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

Contractual information is presented in French and will be confirmed at the latest when your order is validated.
The company Chef de File reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
Article 4 - Validation of your order
Any order placed on the www.chefdefile.com website implies acceptance of these General Terms and Conditions. Any confirmation of an order implies your full acceptance of these General Terms and Conditions of Sale, without exception or reservation.
All data supplied and the recorded confirmation shall constitute proof of the transaction. You declare that you are fully aware of them. Confirmation of the order will constitute signature and acceptance of the operations carried out.
A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the e-mail address used to confirm your order.
Article 5 - Payment
The fact of validating your order implies for you the obligation to pay the indicated price.
Payment for your purchases is made by credit card using the SSL SECURE SHOPPING secure system via Stripe.
The card is debited upon validation of the order for the COLLECTION section. For the CUSTOM section, payment is made by bank transfer, cheque or cash in two stages for orders over 1000 (one thousand) euros: 50% when the order is placed, 50% when the order is dispatched (orders under 1000 (one thousand) euros must be paid in full in a single instalment).
Article 6 - Withdrawal
In accordance with the provisions of article L.121-21 of the French Consumer Code, you have 14 days from receipt of your products to exercise your right of retraction, without having to justify your reasons or pay any penalty.
Returns must be made in their original state and complete (packaging, accessories, instructions). In this case, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.
You are responsible for return shipping costs.
If you exercise your right of withdrawal, Chef de File will reimburse the sums paid within 14 days of notification of your request by cheque or bank transfer.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to :
- The supply of services fully executed before the end of the withdrawal period and whose execution has begun after prior express agreement by the consumer and express renunciation of his right of withdrawal.
- The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period.
- The supply of goods made to the consumer's specifications or clearly personalized. (Special personalized editions (size or design), totally personalized products in particular).
- The supply of goods likely to deteriorate or expire rapidly.
- The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
- The supply of goods which, after delivery and by their nature, are inseparably mixed with other items;
- The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on market fluctuations beyond the control of the professional.
- The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
- The supply of a newspaper, periodical or magazine, except for subscription contracts for these publications.
- Transactions concluded at a public auction.
- The supply of digital content not supplied on a physical medium, the performance of which has begun after the consumer's express prior agreement and express waiver of his right of withdrawal.
Article 7 - Availability
Our products are offered as long as they are visible on the www.chefdefile.com website and within the limits of available stocks. For products not in stock, our offers are valid subject to production and delivery times by our factories, and if they are still in the catalog. If a product is unavailable after you have placed your order, we will inform you by e-mail. We will propose a solution or your order will be automatically cancelled and you will be reimbursed.
Furthermore, the www.chefdefile.com website (COLLECTION section) is not intended to sell its products in large quantities. Consequently, Chef de File reserves the right to refuse orders for more than 10 (ten) identical items on the COLLECTION section. For the CUSTOM section, you will be guided by our sales team and we will do our best to meet your requirements.
Article 8 - Delivery
Products are delivered to the delivery address indicated during the order process, within the time indicated on the order validation page. In the event of a delay in shipment, an e-mail will be sent to you to inform you of any consequences on the delivery time indicated. In accordance with legal provisions, in the event of late delivery, you have the right to cancel the order in accordance with the terms and conditions set out in article L 138-2 of the French Consumer Code.If you receive the product in the meantime, we will reimburse you for it and the delivery costs in accordance with Article L 138-3 of the French Consumer Code. In the case of deliveries by a third-party carrier or otherwise, the company Chef de File cannot be held responsible for any delay in delivery due exclusively to the customer's unavailability after several proposed appointments or to delays in the third-party carrier's delivery process.
Article 9 - Warranty
All our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, as stipulated in articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed. All claims, requests for exchange or refund must be made by e-mail to "hello@chefdefile.com" within 30 days of delivery. Products must be returned to us in the condition in which you received them, with all accessories, packaging and instructions. Shipping costs are the responsibility of the sender, so the customer is responsible for shipping the product, and Chef de File is responsible for shipping a new or repaired product. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
Article 10 - Liability
The products offered comply with current French legislation. Chef de File shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibility of importing or using the products or services you intend to order. Furthermore, Chef de File cannot be held responsible for damage resulting from misuse of the product purchased or its packaging. Lastly, Chef de File may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
Article 11 - Applicable law in the event of disputes
The language of the present contract is French. The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Article 12 - Intellectual property
All elements of the www.chefdefile.com website are and remain the exclusive intellectual property of the company Chef de File. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written, oral and visual consent of the company Chef de File (or its legal representative(s) (natural persons)).
Article 13 - Personal data
A&R ASSOCIATES (Lead Partner) reserves the right to collect nominative information and personal data concerning you. This information is required to process your order, and to improve the services and information we send you. It may also be transmitted to companies that contribute to this relationship, such as those responsible for the management, execution, processing and payment of services and orders. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.
The data processed by A&R ASSOCIATES (Lead Partner) is collected, recorded and stored in compliance with the provisions of the French Data Protection Act of January 6, 1978 in the version in force on the date hereof, as well as with the provisions of the General Data Protection Regulation (RGPD).
The data collected corresponds to the information you send us on the contact forms accessible online, or via the cookies deposited on your browser during your visit to our site. As part of our activities as a communications and strategy consultancy agency, we may also access data relating to your professional activity. We may also act as a processor, within the meaning of Article 4 of the RGPD, when we process, at your request and under your control, your customers' data.
Article 14 - Archivage Preuve
La société Chef de File archivera les bons de commandes et les factures sur un support fiable et durable constituant une copie fidèle conformément aux dispositions de l'article 1348 du Code civil. Les registres informatisés de la société Chef de File seront considérés par toutes les parties concernées comme preuve des communications, commandes, paiements et transactions intervenus entre les parties.
